Personal Care Attendant Found Not Guilty On 2 Sexual Conduct Charges

MINNEAPOLIS (WCCO) — Isaac Aboki was found not guilty on two charges of criminal sexual conduct Friday after being accused of sexually abusing a 70-year-old woman in 2018. At the time, Aboki was a personal care attendant at a Burnsville senior care center.

Aboki was acquitted of second degree personal injury and first degree penetration of a mentally impaired or physically helpless victim.

The jury is deadlocked on a third felony charge of fourth degree criminal sexual conduct. The Dakota County Attorney’s Office said the office intends to retry Aboki on this charge if able.

 


Minnesota State Trooper Accused Of Sexually Abusing 14-Year-Old Girl

MINNEAPOLIS (WCCO) — A Minnesota State Trooper has been placed on investigative leave after being charged with allegedly sexually abusing a 14-year-old girl multiple times.

Shawn Gerald Barta, 36, of Burnsville faces felony charges of first- and second-degree criminal sexual conduct with a victim under 16 years old in connection to the alleged crimes that took place between April 2018 and July 2019.

According to the criminal complaint, Burnsville police were contacted on July 7 about an incident involving a sexual assault. The reporting party said his daughter, an unidentified 14-year-old girl, disclosed to her grandmother that she was being sexually abused by Barta.

The victim said Barta had begun abusing her during the spring of 2018 and continued until the most recent incident on July 2, 2019. The complaint says that the 14-year-old girl is cognitively delayed and functions at about a 6th grade level.

Barta was interviewed by police and admitted being alone with the victim when she was “hiding” from her siblings. He denied anything sexual happening between him and the victim, the complaint said.

The Minnesota State Patrol confirmed that Barta is a Minnesota State Trooper and released a statement.

“The alleged conduct outlined in this complaint is extremely disturbing and completely inconsistent with the core values of the Minnesota State Patrol. Mr. Barta has been placed on investigative leave pending the outcome of the criminal process and an internal affairs investigation,” the state patrol said.

If convicted, Barta could face up to 30 years in prison on the first-degree criminal sexual conduct charge and up to 25 years on the second-degree criminal sexual conduct charge.

Shoreview Man Who Filmed Himself Sexually Assaulting Women Pleads Guilty

MINNEAPOLIS (WCCO) – A 33-year-old Shoreview man who authorities say videotaped himself sexually assaulting women while they slept has pleaded guilty to stalking and criminal sexual conduct.

Jeffrey Eldred pleaded guilty to one count of stalking, five counts of third-degree criminal sexual conduct and one count of fourth-degree criminal sexual conduct, Hennepin County Attorney Mike Freeman announced Monday. He was also charged with attempted third-degree criminal sexual conduct in Ramsey County.

According to a criminal complaint, Eldred had an intermittent relationship with a Bloomington woman from late 2017 through most of last year. Authorities say Eldred waited until “she was passed out and physically helpless before sexually assaulting her” on several occasions at her home. Eldred told police the victim did not know she was being filmed.

Last fall, a woman who stayed the night at Eldred’s home in Shoreview awoke to find him trying to have sex with her while videotaping it. In the morning, the woman was using his computer and found at least 40 videos of him having sex with women while they slept. She took photos of the videos and turned them over to the Ramsey County Sheriff’s Office.

Authorities were able to identify the Bloomington woman and a woman for the case in Ramsey County. Though investigators say they hoped to identify other women in the videos, no other charges have been filed against Eldred.

As part of his plea, Eldred admitted factors including “multiple penetrations and cruelty” that will allow the judge to sentence him to more prison time than recommended by state guidelines.

Sentencing is set for Sept. 30.

Charges: Psychotherapist Gavin Meany Had Sexual Relationship With His Patient

MINNEAPOLIS (WCCO) – Twin Cities psychotherapist Dr. Gavin Meany is charged with having a sexual relationship with one of his patients.

Meany is accused of sexual misconduct with a patient both during and outside of their sessions. He has been charged with two counts of third-degree criminal sexual conduct.

According to the criminal complaint, 38-year-old Gavin Meany first met the victim in 2015 when she sought his psychiatric services at a clinic in St. Louis Park. She told police there were times she felt “uncomfortable” when he asked her personal and sexual questions during sessions. He would rub her hands during sessions, claiming she was cold.

The victim saw Dr. Meany for a year while he prescribed medication, but he was fired from that job in 2017. The victim started seeing Dr. Meany at another St. Louis Park clinic, where he touched her sexually during appointments.

In 2018, the victim began seeing Dr. Meany at a Burnsville clinic, where the alleged inappropriate touching became more intense. The two eventually met at the doctor’s home to have sex after he told her they “should not because it’s illegal.”

The sexual relationship continued during sessions until the victim confided in a new therapist in August and it was reported to police.

The Dakota County Attorney’s Office says it is against the law for a psychotherapist to have a sexual relationship with a patient who is under their care.

“These are obviously very disturbing allegations in this criminal complaint,” Dakota County Attorney James Backstrom said. “There is a patient we’re alleging was seriously harmed in terms of the trauma that she’s endured as a result of the actions of this professional.”

The alleged crimes out of St. Louis Park are under investigation in Hennepin County. Meany was released from jail on bail. He did not respond to WCCO’s request for comment.

Charges: Minneapolis Man Raped Woman, Threatened Her With Narcan

MINNEAPOLIS (WCCO) – A Minneapolis man accused of sexually assaulting a woman and threatening her with a syringe of Narcan, a medication used to combat opioid overdoses, has been charged with criminal sexual conduct.

Authorities say 38-year-old Daniel David Ellington is being held in the Washington County Jail on felony charges related to sex trafficking.

During the sex trafficking investigation, officers seized and searched a cellphone belonging to the victim. A video dated March 10 depicts Ellington threatening to inject the woman with Narcan after she tells him she is leaving.

Injecting someone who isn’t overdosing with Narcan has serious negative side effects. Investigators say Narcan can put a person into immediate opioid withdrawal and can be a threat to an opioid user, which the woman is known to be.

According to the criminal complaint, the woman can be heard crying in the video and telling Ellington to get away from her. After she is again threatened with Narcan, she can be heard crying and telling Ellington to stop.

The woman told investigators Ellington used the threat of Narcan injection and the needle to control her and force her to engage in sex.

Authorities say the woman is also the victim in the sex trafficking case for which Ellington has been charged.

Kenneth Clark Gets 12 Years In Prison For Assaulting Woman In His Cab In 2012

MINNEAPOLIS (WCCO) — Kenneth Keith Clark was sentenced Monday to 144 months in prison after being found guilty of first-degree criminal sexual conduct.

The assault happened in November 2012. The victim was a grandmother who was contacted as part of the Sexual Assault Kit Initiative grants introduced in 2016. She wanted to proceed with the investigation.

Clark was charged in 2012 after evidence indicated he forced a woman into sexual conduct in his cab. Although police promptly responded, the office says miscommunication between police and the Bureau of Criminal Apprehension lab caused a delay in the investigation.

Clark, now 66, was found guilty in June based on the “newly discovered powerful DNA evidence,” the office said.

The 12-year sentence is within standard sentencing guidelines.

Twin Cities McDonald’s Manager Gets 10 Years For Raping 14-Year-Old Employee

MINNEAPOLIS (WCCO) – A former McDonald’s manager in the Twin Cities was sentenced this week to 10 years in prison for raping a 14-year-old employee.

The Hennepin County Attorney’s Office says 25-year-old Andrew Albertorio was sentenced Monday to 120 months in prison, although prosecutors were seeking 144 months.

According to the attorney’s office, District Court Judge Jeannice Reding opted for a lesser sentence because Albertorio had a limited supervisory role in relation to the victim.

In November, Albertorio pleaded guilty to one count of first-degree criminal sexual conduct. In court Monday, he apologized to the harm done to the victim and her family.

However, prosecutors say that he did not exhibit remorse throughout the case.

According to a criminal complaint, the victim began working at the Maple Grove McDonald’s in the summer of 2017. Albertorio was her night manager. He flirted with her and spoke about having sex with her, to which the girl objected.

The victim told investigators Albertorio was respectful until she found herself alone with him in the restaurant’s walk-in cooler, feeling pressured to have sex with him.

Albertorio had sex with the teenager several more times at the restaurant, in his car and his home in the following months. The victim also told investigators that Albertorio gave her additional hours and paid her “out of pocket” to avoid child labor law violations.


Psychotherapist Gavin Meany Pleads Guilty To Having Sex With Patient

MINNEAPOLIS (WCCO) – A Twin Cities psychotherapist pleaded guilty Thursday to having a sex with a patient.

The Dakota County Attorney’s Office says 38-year-old Gavin Patrick Meany, of Apple Valley, pleaded guilty for four counts of third-degree criminal sexual conduct. He is slated to be sentenced on April 20.

“Criminal activity of this nature is a significant breach of trust by a psychotherapist as to any patient,” County Attorney James Backstrom said, in a statement. “We are pleased the defendant has accepted responsibility for this egregious behavior by his guilty plea.”

According to a criminal complaint, the victim reported to police in August that she had been abused by Meany over the last five years while she had been receiving therapy from him.

The woman told police the abusive acts, from inappropriate touching to sex, had taken place in Meany’s offices in St. Louis Park, Burnsville and in Meany’s home.

While being questioned by investigators, Meany acknowledged that he had “crossed boundaries” and admitted to the activity the victim described to police.

In Minnesota, it is illegal for a psychotherapist to have sex with a patient, even if the patient gives consent.

Charges: Albany School Teacher And Coach Daniel Fragodt Had Sexual Relationship With Student

MINNEAPOLIS (WCCO) — A 31-year-old Albany school teacher was charged with criminal sexual conduct in Stearns County District Court on Monday.

Court documents allege that a 14-year-old girl said she knew Daniel Sinclair Fragodt as a teacher and coach at Albany schools, and that he’d “touched her inappropriately over the clothing several times.”

During an interview at the Child Advocacy Center the girl said Fragodt “rubbed her thighs with his feet and brushed against her buttocks with his hand.”

Then, “just prior to quarantine break” the victim said he slide a finger into a hole in her jeans to touch her bare leg. According to police, another 14-year-old girl said she was in the classroom at the time and witnessed it happen. She described the hole as being about “four inches down from the waist of the pants.”

Law enforcement later found the jeans and examined a hole in the material “approximately two to three inches below the waist.”

The 14-year-old girl also said that Fragodt was in a relationship with another 18-year-old.

That girl was then interviewed, and she said she knew Fragodt was a “math teacher and coach for cross country, basketball and track,” at first denying any sexual contact with him, according to the criminal complaint.

Police obtain phone records from Fragodt’s phone that “indicated he had extensive contact with the 18-year-old,” dating back to September 2017. They say they found several hours of phone calls between the two, as well as extensive texting. When they brought that information to the girl’s parents, she agreed to come in for another interview.

In the course of that interview, investigators say they learned that Fragodt began a physical relationship with the girl when she was a 17-year-old student. She said there was “sexual contact at the school, the St. Joseph park and ride, and other places in Albany.”

The girl described sexual intercourse “happening five to 10 times,” but said it could have been more than that. Investigators say some of the intercourse happened when she was 17 years old.

If found guilty, Fragoft faces a maximum sentence of 15 years in prison and a $30,000 fine.

Twin Cities Wrestling Coach Accused Of Inappropriately Touching Girls

MINNEAPOLIS (WCCO) — A Twin Cities wrestling coach is accused of inappropriately touching girls, with two victims telling investigators he touched their genitals over their clothing.

Mustafa Shabazz, of Burnsville, was charged via summons this week with one count of second-degree criminal sexual conduct, court documents filed in Hennepin County show. Shabazz, 43, is slated to make his first court appearance Friday.

According to a criminal complaint, Eden Prairie and Shakopee police began investigating Shabazz in February after an 8-year-old girl told her parents that Shabazz would touch her genitals over her clothing while demonstrating wrestling techniques at an Eden Prairie facility.

Shabazz would claim the touching was accidental, the girl told police. However, the touching happened several times.

The girl began her training with Shabazz in 2018, and refused to return to practice in early 2019 following an injury. Months later, she told her parents about the touching.

Because Shabazz is more than 30 years older than the girl and was in a position of authority, prosecutors in Hennepin County are seeking an aggravated sentence. The normal maximum sentence for second-degree criminal sexual conduct is 25 years in prison.

According to the complaint, investigators say that Shabazz resigned from another wrestling program in 2019 after allegations surfaced that he had caressed an adolescent girl’s back.

The victim later told investigators that Shabazz would touch her genitals over her clothing while at wrestling tournaments. According to the girl, Shabazz told her that if she told anyone about the touching, no one would believe her.

Additionally, investigators say that Shabazz was dismissed from a job working with children in 2013 after allegedly having inappropriate contact with a 14-year-old girl, which included a meeting at a motel room.

Predatory Offender, Michael Landon, Indicted In South Minneapolis Rape Case

MINNEAPOLIS (WCCO) — A 47-year-old Minneapolis man with history of sexual violence is accused of beating and raping a woman earlier this year.

A Hennepin County Grand Jury on Thursday indicted Michael Landon for first-degree criminal sexual conduct in connection to the Jan. 20, 2020 incident. Landon has a previous conviction of first-degree criminal sexual conduct in 2004.

According to the county attorney’s office, Landon was noncompliant with his predatory offender registration when the 2020 incident occurred.

Landon allegedly invited a woman, who was near the light rail platform on Lake Street and Hiawatha, to his south Minneapolis home. She later fell asleep at the residence and woke to Landon sexually assaulting her, the complaint said.

According to the complaint, the victim attempted to push Landon away, but he punched her, put her in a chokehold and continued to sexually assault her.

“When Landon finished, he told the victim to leave. The victim then left the house and walked over two miles from south Minneapolis to a downtown Minneapolis hospital to receive medical attention,” the attorney’s office said.

At the hospital, the victim was treated for a broken eye socket. She was able to identify Landon from a variety of photos, and Landon was arrested shortly after.

If convicted, Landon could face up to life in prison with the possibility of parole after 30 years. His first appearance is Friday afternoon.

Fmr. Anoka Theater Teacher, Jefferson Fietek, Accused Of Sexually Abusing 4 Juvenile Students; Investigation Ongoing

MINNEAPOLIS (WCCO) — A 46-year-old Massachusetts man — who is a former theater teacher at a middle school in Anoka — faces multiple charges accusing him of sexually abusing four juvenile students.

On Friday, the Anoka County Sheriff’s Office said Jefferson Jerome Fietek, of Malden, Massachusetts, was arrested by Malden police and will be held in a local jail while waiting for extradition to Minnesota.

According to the criminal complaint, the sexual assaults took place at Anoka Middle School for the Arts, previously Fred Moore Middle School, and in surrounding areas of Anoka County, including Fietek’s home.

Initially, police began investigating when two juvenile victims reported being sexually assaulted by Fietek. Then, two additional juvenile victims came forward during the investigation. The victims’ ages ranged from 14 to 16 years old, with the assaults occurring over the span of nearly 10 years, from 2009 to 2019.

Fietek now faces seven felony charges of criminal sexual conduct, with four of those being first-degree. First-degree criminal sexual conduct carries a maximum sentence of 30 years in prison and/or a $40,000 fine.

The investigation is ongoing. Authorities are encouraging victims of sexual assault related to this case, or any other suspect, should report the assault to law enforcement. In Anoka County, victims can call 763-427-1212.

A spokesperson from Anoka-Hennepin School District 11 gave this statement Friday to WCCO:

The district did investigate three complaints against Jefferson Fietek during his time with the district and none of them resulted in discipline. So, by Minnesota law the results of those complaints remain private employee data. I can confirm that if a complaint came forward regarding criminal sexual conduct the district would immediately report it to law enforcement and to the Minnesota Department of Education as required by law. This is what happened when the district was alerted to information on a Facebook post on June 25.

‘He Just Had A Lot Of Control’: Parents Warned School District Of Jefferson Fietek Years Before Sex Abuse Charges

MINNEAPOLIS (WCCO) — A 46-year-old Massachusetts man who formerly taught teacher at Anoka Middle School for the Arts is facing seven felony charges of criminal sexual conduct for allegedly sexually abusing four juvenile students.

Jefferson Jerome Fietek was arrested in Massachusetts on Friday and will be extradited to Minnesota.

Amy Mills was a proud theater parent at the school, supporting her daughter as a program volunteer from 2014 to 2017.

“I was at every show, I was with every cast before the show, I did makeup for several shows, I just was the mama bear while I was there,” Mills said.

Her role as theater “mama bear” allowed her to notice theater director Jefferson Fietek’s suspicious behavior almost immediately.

“It was just trickles, right? It was, you know, inappropriate amount of attention towards specific kids. It was touching that felt a little bit more than what it should be, and I wasn’t the only that saw it. My husband saw it clear of day as well,” Mills said.

Aileen Mucangi removed her son from Fietek’s class several years ago after the then-seventh grader told her he was uncomfortable.

“He said he keeps touching people and he kept touching him, and I asked him where, and he said shoulders,” Mucangi said.

A warrant now details what victims allege was happening behind the scenes at the hands of now-46-year-old Fietek. The warrant outlines accusations from four male victims who say Fietek engaged them in sexual acts when they were teens at his home and the middle school, among other places.

The accusations dating back to 2009, but allegedly happened as recently as 2019 — the year he resigned from the school. Fietek met one student through a dating app, but the others through theater.

“He put himself in this position of just, you know, godliness,” Mills said. “He just had a lot of control.”

Mills says she made an anonymous call to the school principal in 2016 to alert her to Fietek’s inappropriate behavior with students, including rubbing shoulders and heads.

“I expressed my concerns of possible grooming with her, and was immediately presented back with, ‘Well, he just really loves his students,’” Mill said.

Mucangi says she alerted the school as well to no avail.

“They dismissed us instead of listening,” Mucangi said. “If they paid attention to the many concerns we had, this would have been stopped.”

Officials from Anoka-Hennepin School District 11 say they “did investigate three complaints against Fietek during his time with the district and none of them resulted in discipline.”

“He didn’t only groom children, but he massively groomed the parents and the adults, and also the community as a whole,” Mills said. “I don’t know how the school could’ve turned their eye to everything.”

Of the seven felony charges Fietek faces, four of them are first-degree level. First-degree criminal sexual conduct carries a maximum sentence of 30 years in prison and a possible $40,000 fine.

Fietek first gained media exposure about a decade ago as an advocate for LGBTQ+ students after several students in the district committed suicide in a span of a couple years. He also ran for a Minnesota House seat in 2014.

Charges: Forest Lake Shop Teacher Sexually Abused Boys He Hired To Work On His Home

MINNEAPOLIS (WCCO) — A middle school shop teacher for Forest Lake Area Schools is accused of sexually abusing teenage boys whom he had over to his home to work on projects for cash.

James Carter, 56, of Forest Lake, is charged with two counts of second-degree criminal sexual conduct (position of authority and threat of harm) and one count of fourth-degree criminal sexual conduct, court documents filed this week in Washington County show.

“The defendant wholly abused his position of authority as a teacher and trusted adult to these young boys,” Washington County Attorney Pete Orput said, in a statement. “This abuse and breach of trust erodes the very foundation of our education system and will never be tolerated.”

According to a criminal complaint, two middle school-aged boys reported that Carter would touch their groin area while giving them massages at this home. One of them was a shop student; the other was boy had Carter as an advisor.

The boys told investigators that they were 15 when they were first touched. Both had similar stories, involving Carter buying them gifts or food, and inviting them over to watch church services or work odd jobs for cash.

For one victim, the gifts were lavish, including a $5,000 lawn mower. The other victim described Carter as a “nice guy” whom he initially trusted.

When alone at Carter’s home, the boys said he would ask if they wanted a massage. The massage would eventually involve him touching the boys’ groin and/or buttocks over their clothes.

“This is just between us,” he allegedly told one of the boys whom he’d massaged more than once, the complaint states. That victim reported that he feared saying no to Carter, as the teacher had shown him his gun collection and he thought Carter might hurt him if he refused.

Per the complaint, Carter would often slap boys he had over to work on the buttocks. He’d also hug them before they left and engage in “sack slapping,” where he’d tap the boys’ testicles as though it were a game.

Investigators say that when they were executing a search warrant at the home, another teenage boy showed up there to work. According to the complaint, nine other high school-aged boys worked for Carter at his home.

If convicted of the criminal sexual conduct charges, Carter faces up to 60 years in prison.


Tyree Johnson, 29, Indicted By Grand Jury On Criminal Sexual Conduct, Kidnapping Counts

MINNEAPOLIS (WCCO) — A 29-year-old man has been indicted by a grand jury in Hennepin County on two counts of first-degree criminal sexual conduct and one count of kidnapping.

Investigators say DNA evidence connects Tyree Terrell Johnson to an assault that happened June 24. Police responding to the 2000 block of Glenwood Avenue North found a woman crying on her front steps, with a swollen eye and bleeding from the mouth.

The woman was taken to North Memorial Medical Center for examination. There she told police that the man who investigators later determined was Johnson approached her at her home on the 300 block of Newton Avenue North.

He asked her for a lighter and, when she stopped to hand him one, he punched her, covered her mouth and dragged her behind a church nearby, where he choked her and sexually assaulted her.

She said she was eventually able to run away to where police found her.

Johnson is a convicted predatory offender on first-degree criminal sexual conduct charges. His bail has been set for $2 million, and his jury trial begins in October.

Charges: Eden Prairie Tae Kwon Do Instructor Sexually Abused Underage Female Student

MINNEAPOLIS (WCCO) — A 32-year-old Eden Prairie man is in custody facing charges accusing him of sexually abusing an underage female student while he worked as a Tae Kwon Do instructor.

According to the Hennepin County Attorney’s Office, Hyobin Lee faces two counts of first-degree criminal sexual conduct of a victim between the ages of 13 to 15 years old in a position of authority.

The criminal complaint says Eden Prairie police were notified on Sept. 21 of a sexual abuse through a mandatory reporter in the Scott County School District. The now 17-year-old female victim said she was a student in a Tae Kwon Do studio located in Eden Prairie, a city where she also lived. She said she was a student of Lee’s and that he had taken her virginity.

The victim said the abuse began in July 2018, three years after she began lessons from Lee. He allegedly would tell her in several of these incidents not to tell anyone about what was happening. She said interactions with Lee stopped in November 2018 when a new Taw Kwon Do studio location opened closer to her house and she began going there, according to the complaint.

Officers spoke with a witness, who was a previous instructor and employee at the same studio as Lee.

“The Witness described the Taw Kwon Do hierarchical system of doing things for your Master when asked. The Witness described this seemed to be taken too far at the Eden Prairie studio and it felt like a person ‘needed’ to or they would get into trouble,” the complaint said.

Lee was arrested and taken into custody. If convicted, he faces up to 30 years in prison and/or a $40,000 fine, plus a conditional release.

Charges: Bloomington Public Schools Employee Sexually Assaulted Multiple Children In His Neighborhood In 1970s

MINNEAPOLIS (WCCO) — A 65-year-old Bloomington man and employee of Bloomington Public Schools is accused of sexually assaulting multiple children in his neighborhood in the 1970s, according to the Hennepin County Attorney’s Office.

Kevin Belker faces felony charges of first- and second-degree criminal sexual conduct of a victim under 13 years old in connection with the alleged assaults of two victims that took place between 1977 and 1980.

According to the criminal complaint, an investigation began in November when Bloomington police were notified by an employee of Bloomington Public Schools that they received a complaint that a current employee had been accused of sexual assault in the 1970s.

“Police followed up and found that Belker sexually assaulted several victims that lived in his neighborhood between 1973 and 1980,” the attorney’s office said.

One of the victims was recently in counseling and recalled being molested by Belker, according to the complaint. He later went online and saw that Belker was still working for Bloomington Public Schools, so he reported it to the district.

Four other victims came forward and gave detailed accounts of how Belker would molest them, which would usually occur at his Bloomington house. At least one assault took place in a movie theater. The victims’ ages ranged from 8 years old to 12 years old. Belker would have been in his 20s and had a younger sibling who was of similar age to the victims, the complaint said.

The criminal complaint involves five victims, but Belker is currently facing charges for the alleged sexual assaults of two victims. His first court appearance is scheduled for Tuesday afternoon.

Belker still lives at the same home he lived in during the time of the alleged crimes. He’s currently on administrative leave with Bloomington Public Schools, per the school district’s policies.

A school district representative confirmed Belker was hired in September 2018 as a special education paraprofessional. He worked one school year at Olson Middle School and then half of the 2019-2020 school year at Oak Grove Middle School.

He’s being held at the Hennepin County Jail. If convicted, Belker faces up to 30 years in prison on the first-degree felony charge and up to 25 years on the second-degree felony charge.

Minneapolis Dance Instructor Charged With Raping 13-Year-Old Student

MINNEAPOLIS (WCCO) — A Minneapolis dance instructor is charged with raping one of his teenage students earlier this week.

Decorey Bozeman, 28, is charged with one count of first-degree criminal sexual conduct with an underage victim while being in a position of authority, the Hennepin County Attorney’s Office said. Bozeman made his first court appearance Wednesday. His next court appearance is slated for Jan. 28.

According to a criminal complaint, investigators spoke with the 13-year-old victim who reported that he’d been assaulted Monday by his dance teacher.

Bozeman also called police and reported what happened, the attorney’s office said.

In speaking with investigators, Bozeman said that he picked up the student from the dance studio on Sunday and they spent the night at his Minneapolis apartment, the complaint states. Bozeman admitted to engaging in a sex act with the victim on Monday.

If convicted of the criminal sexual conduct charge, Bozeman faces up to 30 years in prison.

Bozeman is currently in the Hennepin County Jail. His bail was set at $500,000.

MINNEAPOLIS (WCCO) — A Shakopee man faces charges of repeatedly sexually assaulting an employee he managed at a popular Halloween attraction who, at the time, was 15, according to a criminal complaint.

Bryan Ellinger, who was 24 at the time of the 2013 assaults, is charged with first- and third-degree criminal sexual conduct.

According to the complaint, the victim reported the assault in November 2020. She said while working at Trail of Terror in 2013, she had a crush on Ellinger, her manager, and the two began a “sexual relationship” that lasted two to four months.

The weekend after Halloween 2013, the complaint states, the victim went with Ellinger and several friends to stay the night in a hotel room, where they gave her alcohol and showed her pornography.

The victim said she “became so intoxicated she passed out on the bed,” and awoke to find Ellinger sexually assaulting her while other people watched. She then passed out again.

The relationship between Ellinger and the victim ended in February 2014, and the two had little contact for the next seven years. Ellinger reached out to the victim via Snapchat in 2020, the complaint states.

In that conversation, Ellinger apologized for “playing with [the victim’s] feelings” and for “leading [her] on” and “sleeping with [her].” The victim accused Ellinger of raping her “in front of everybody.”

Ellinger admitted he had “no excuses,” and when the victim called him a “predator,” he said, “Yea, I really was not going to lie,” according to the complaint.

When contacted by a detective, Ellinger admitted to a “sexual relationship” with the victim, though he said he did not remember much of the “drunken night” at the hotel.

The detective asked Ellinger why he would give alcohol to a 15-year-old girl, and Ellinger allegedly replied, “Come on, teenagers like to party.” The complaint states Ellinger “did not dispute the age or seem surprised.”

Ellinger worked at Trail of Terror for 10 years, but is no longer employed there. He has a previous criminal sexual conduct case on his record, and told police he was required to register as a predatory offender. A warrant has been issued for his arrest.
